Same-Sex Domestic Partner Benefits

Will any children affected by the change in FEHB and FEDVIP benefits for children of domestic partners be eligible for Temporary Continuation of Coverage if their parents fail to get married before January? Will an employee have to payback benefits received in 2016 for a child affected by the policy if the employee fails to tell HR until much later that the child became ineligible for benefits in January?
