In addition to the two categories of employees who are barred from telework under the Act (i.e. an employee who has been 'officially disciplined' for being absent without permission for more than 5 days in a calendar year or an employee for viewing, downloading, or exchanging pornography, including child pornography, on a Federal Government computer), the Act also specifically restricts employees who handle secure materials at least once per month from participation in overseas telework. Each agency also has the discretion and authority to establish other eligibility requirements and restrictions.
